Notaries Public have the sole responsibility for undertaking tasks associated with enabling documents to be relied upon overseas. If the document is to be relied upon in another country then Justices of the Peace, Commissioners for Declarations or solicitors cannot fulfil the function of a Notary Public.
Authentications and Apostilles (a French word meaning “certificate”) can only be applied in verification of the signature and seal of a Notary Public and those verifications are undertaken by the Department of Foreign Affairs and Trade. Notaries Public do not affix Apostilles or Authentications. So often it is a two step process – first attending a Notary Public and secondly attending the Department of Foreign Affairs and Trade for an Apostille (verification of the Notary’s signature and seal by way of a certificate). In the case of countries that are not members of the Hague Convention relating to Apostilles then an authentication of the Notary’s signature and seal is required with the further and third step of then legalising the document at the relevant embassy or consulate of the country concerned.
